HWW Partner Joe Hinkhouse Secures Dismissals for Insurer Client in Multi-State Complex Coverage Litigation.
In separate orders dated April 28, 2009 and April 10, 2009, courts in parallel Indiana and Illinois proceedings dismissed with prejudice coverage claims against HWW’s insurer client in a matter involving over $100 million in exposure arising out of medical devices to treat abdominal aortic aneurysms. HWW Partner Joe Hinkhouse litigated the case in both states from inception through dismissal, at both the trial court and appellate levels. His representation included oral argument before the Illinois Appellate Court on a coverage issue of first impression involving a policy’s “Batch Clause,” successfully persuading the Court to grant affirmance in his client’s favor.
